This excerpt from the MBIYC Dock Policy applies to I-LYA affiliated members use of the MBIYC Dock Facilities.

While members from most I-LYA Clubs are welcome at MBIYC, there are a few who are not due to reciprocity differences. Check with your Fleet Captain or the MBIYC dockmaster.

    10.4          Usage of Docks by I-LYA Affiliated Members

OBJECTIVE

The objective of this Dock Policy is to promote fair and equitable use of the dock system operated by Middle Bass Island Yacht Club and provide necessary guidelines for members in order to make everyone’s stay safer and more enjoyable. MBIYC asks members to review this policy and work with the Dock Master to obey them.

SECTION I
DEFINITIONS

1.1              Club or MBIYC means The Middle Bass Island Yacht Club.

1.2              Dock Master means the person employed or enlisted by the Club to operate the docks in an orderly manner in accordance with the Dock Policy and Constitution of MBIYC.

1.3              Member means an active member in good standing of MBIYC.

1.4              I-LYA affiliate means an active member in good standing of another yacht club that is a member of the Inter-Lake Yachting Association.

1.5              Based Dock Holder means a Member that has rented a dock for the season at the Club and will base their vessel at MBIYC.

1.6              Non-Based Dock Holder means a Member that has rented a dock for the season at the Club and will base their vessel at other than MBIYC.

1.7              Primary Dock Holder means a Based or Non-Based Dock Holder that holds the right to rent the MBIYC seasonal dock, as defined in this policy.

1.8              Sharing Dock Holder means a Member from the top of the Dock Waiting List that has agreed to share the cost of a dock with a Primary Dock Holder.

1.9              Temporary Dock Holder means a Member from the top of the Dock Waiting List that has agrees to rent a MBIYC seasonal dock for one season due to a leave of absence by the Primary Dock Holder.

1.10          Permanent Dock means a seasonal dock rented to a Primary Dock Holder.

1.11          Temporary Dock means a seasonal dock rented to Temporary Dock Holder.

SECTION II
RULES AND REGULATIONS

2.1              All members may utilize the Club facilities, including docks, aboard any vessel of appropriate size, as determined by the Dock Master, regardless of ownership.

2.2              Members may bring guests to the Club and/or use the guest’s vessel at the Club. Non-members may not stay at or use the Club facilities without the member being present.

2.3              All members and I-LYA affiliates are required to show proof of membership upon request.

2.4              Quiet hours are from 11:00 PM to 7:00 AM. MBIYC prohibits excessive noise or profanity at the Club. After 11:00 PM, members, guests and I-LYA affiliates are asked to relocate any activity that would tend to annoy fellow members in and around the dock area to the clubhouse area.

2.5              The Club allows pets. Pets must be on a leash when not aboard a boat. Owners must walk their pets to the designated area for their personal relief needs. Owners shall immediately clean up after their pets anywhere on Club property. The Club does not permit pets in Club buildings or showers.

2.6              Permitted within a dock with your main boat are personal watercraft, inflatable boats and dinghies. Non-Based Dock Holders may not leave this type watercraft at MBIYC when vacating their dock overnight without the prior permission of the Dock Master. Based Dock Holders may store these watercraft in their dock with their main boat provided they do not impede the normal flow of traffic as determined by the Dock Master.

2.7              MBIYC prohibits firearms or fireworks on Club docks or grounds.

2.8              MBIYC is not responsible for loss or damage to vessels or other property within the Club or in the marina.

2.9              Members must confine alcoholic beverages to the Club facilities. State Park officers may ticket violators.

2.10          All members, guests and I-LYA affiliates will observe proper respect and consideration of the Dock Master’s authority.

2.11          The established hailing channel is VHF Channel 69.

2.12          Dock Use Rules:

2.12.1    There is no swimming within the marina.

2.12.2    No wake within the marina.

2.12.3    Checkout time is 10:00 AM. The Dock Master may grant extensions.

2.12.4    All docked vessels must display a MBIYC seasonal dock sticker or MBIYC dock permit in the dockside of the boat.

2.12.5    Members are responsible for the conduct of their guests. Dockage may be revoked, denied, or forfeited and boat evicted at any time for disruptive behavior, without refund. Any action involving a tow will be at the member’s expense.

2.12.6    Except for Based Dock Holders, all Non-Based Dock Holders and other dock renters shall remove dock lines, power cords, fenders and other boating equipment from the Club docks when vacating the dock for any overnight period.

2.12.7    Dock Holders shall make no modification or permanent attachment of equipment to any club dock without the prior approval of the dock committee. Dock boxes are not permitted.

2.12.8    No open fires or lighted grills on boats or docks within the marina.

2.12.9    Non-seasonal renters shall not leave their boats unattended overnight without the prior approval of the Dock Master.

2.12.10      Rafting of vessels is not permitted.

2.12.11      Operation of portable generators is not permitted. Vessel generators must be turned off between 11:00 PM and 7:00 AM.

2.12.12      There are to be no open fuel containers on the docks.

2.12.13      MBIYC requests vessel operators to remove their rubbish from the island.

SECTION III
UTILITIES AND GENERATORS

3.1              Each dock is equipped with electrical power and water. Members are required to supply all necessary cords, splitters/converters to power their vessel. Any member utilizing more than the designated source for their assigned dock may be disconnected without notification.

3.2              MBIYC does not guarantee the constant supply or quality of utilities provided and is not liable for damaged equipment or loss of supplies because of utility disturbance or interruption.

3.3              Vessel generators may not be operated between the quiet hours of 11:00 PM and 7:00 AM due to noise and safety considerations.

3.4              Portable generators are not permitted on the docks due to noise and safety considerations.

SECTION IV
DISCIPLINE

4.1              The MBIYC Board of Directors will take all necessary actions and disciplinary measures for unsatisfactory behavior by members, guests or I-LYA affiliates, as stated in the Constitution.

SECTION VI
ASSIGNING OF DOCKS

6.1              The Dock Committee assigns seasonal docks. The Dock Master assigns other dock rentals. When making dock assignments, they shall take into consideration proper spacing with regard to length, width and draft of the docking vessel for the safety of that vessel and other nearby vessels. The dock assigned shall not cause the vessel to restrict access to other docks or produce an unsafe maneuvering condition for other boats.

6.2              The number of Based Dock Holders shall not exceed eighteen (18). All other docks shall be assigned to Non-Based Dock Holders to provide a sufficient quantity of available docks for transient members.

6.3              The Club may refuse dockage at any time due to vessel size.

6.4              All vessels may be reassigned docks relative to electrical power need and usage.

6.5              A member may only rent one seasonal dock at any given time.

6.6              A Dock Holder may submit a request to the dock committee for relocation to a different dock at any time. The dock committee shall approve the request providing an appropriate dock is available.

6.6.1        If an appropriate dock is not immediately available, the Dock Holder shall be added to the bottom of the Relocation List and relocated, in list order, when an appropriate dock becomes available.

6.6.2        A new Dock Holder that has accepted assignment to a dock larger than they require for their size vessel is automatically added to the bottom of the Relocation List at the time they accept the dock offer.

SECTION X
DOCK USAGE

10.4          Usage of Docks by I-LYA Affiliated Members

10.4.1    Transient dockage is available to I-LYA affiliates except during MBIYC special events. The Dock Master will try to provide the maximum docking opportunities for I-LYA affiliated Dock Holders on a first come, first served basis. Docking opportunities could be restricted due to size of boat. On Fridays and days preceding holidays, docks will be made available to I-LYA affiliated renters after the 12:00 PM (noon) call-in time for seasonal renting members.

10.4.2    All I-LYA affiliated members shall pay a fee as set forth in the schedule of fees each time they use a dock when visiting the club. An overnight fee paid allows the member use of that dock through 10:00 AM the following morning. An additional fee is to be paid for each additional day or portion thereof. A schedule of fees is set by the Dock Committee, approved and published by the Board of Directors.

10.4.3    An I-LYA affiliated renter’s vessel shall not be left unattended overnight at any Club dock, except with the Dock Master’s prior approval. Violation of this rule may result in the member being prohibited from dock usage.

SECTION XI
DOCK FEES

11.1          The Schedule of Fees are established by Dock Committee and approved by the Board of Directors. The schedule is published from time to time as necessary.

11.2          The Schedule of Fees will include time restrictions for the fees paid when not addressed in this Policy.

11.3          Any other docking charges deemed appropriate will be at the discretion of the Dock Master on a case-by-case basis.

11.4          Overnight and day dock fees paid are non-refundable.
